Partner Program Terms & Policies
1. Program Overview
The TX Sparks Luxury Homes Partner Referral Program ("Program") allows approved individuals and organizations ("Partners") to refer prospective luxury home clients to TX Sparks Luxury Homes ("TX Sparks") in exchange for referral commissions, subject to these Terms.
2. Eligibility & Approval
Participation requires submission of a complete partner application and written approval from TX Sparks. TX Sparks reserves the right to approve, reject, hold, suspend, or terminate any partner application or active partner at its sole discretion.
3. Commission Terms
Approved Partners earn a total 2% commission on the executed luxury home construction contract value of each successful referral: 1% paid within 30 days of contract execution, and 1% paid within 30 days of home closing. Commissions are not earned, accrued, or payable until the corresponding milestone is reached.
4. Referral Attribution & Non-Circumvention
Each referred client is attributed to the originating Partner for the life of the project. Partners may not circumvent the Program, attempt to claim referrals not originally submitted through the official partner portal, or interfere with the direct client-builder relationship after introduction.
5. Marketing & Brand Usage
Partners may use the official TX Sparks marketing toolkit (brochures, brand assets, presentations) solely for the purpose of referring clients to TX Sparks. Partners may not modify the TX Sparks logo, misrepresent the company, or make any claims, warranties, or promises on behalf of TX Sparks without prior written consent.
6. Privacy & Client Information
Partners must obtain client consent before submitting their information through the Program. All client data submitted is subject to the TX Sparks Privacy Policy and may not be used by the Partner for any purpose unrelated to the referral.
7. Tax & Independent Contractor Status
Partners participate as independent contractors. Partners are solely responsible for all applicable taxes on commissions received. TX Sparks will issue an IRS Form 1099 annually for partners earning $600 or more in a calendar year, where applicable.
8. Termination
TX Sparks may suspend or terminate any Partner at any time for breach of these Terms, misrepresentation, or for any other reason at its sole discretion. Partners may withdraw from the Program at any time. Commissions earned through the date of termination on closed projects remain payable per the standard schedule.
9. Acceptance
By submitting the partner application and checking the acknowledgment box, the Partner confirms they have read, understood, and agreed to these Partner Program Terms, Commission Policies, Privacy Policy, Non-Circumvention Policy, and Marketing & Brand Usage Guidelines.
